We, the Juries - Recap

<-- Previous EpisodeNext Episode -->
Alicia and Will argue with Judge Spencer that their clients should be allowed separate trials. The couple is accused of smuggling drugs and they were originally represented by one firm. Now that Alicia is gone from LG the judge allows there to be two separate trials. Spencer rules that it will be a double jury so that witnesses don't need to be questioned twice.

Outside of court, Cary offers to be first chair to help Alicia relax. She isn't interested at first but changes her mind when Cary says it will keep Will from getting emotional.

Eli shows the security footage to Peter and Marilyn. He recognizes a person in the video as Jim Moody, Eli's fixer during the campaign. Eli says their lawyers found out the box was stuffed with votes for Peter and Alicia was the one who found this out. Marilyn will have to question her but she wants to talk to Eli first. She says Peter shouldn't talk to Eli alone but he insists on it. Peter tells Eli that on election day, Will tried to show him a video. Eli doesn't think it bodes well because there is a lot of hate for him at LG.

In court, Cary has problems getting along with Dianne during the questioning of possible jurors. After they get out, Will tells Kalinda to dig up any dirt she can on Alicia's client, Howard. The double jury is being used against them so they want to distance themselves from the other half of the defense. Robyn confides to Alicia that they may be able to get another client away from LG. Will has cancelled two meetings with the Paisley Group and they are feeling ignored. Alicia asks her to get dirt on Dianne's client, Darla, because LG is doing the same thing to them. Kalinda approaches Cary but he tries to ignore her. He gives her a minute and she apologizes for things ending badly between them.

The prosecution questions the police about why they stopped the couple at the airport. They looked suspicious and were found to be carrying drugs. Dianne further questions him and brings up the point that Howard's bag contained the drugs. There is only circumstantial evidence that Darla is connected. Alicia later brings up that the bag actually belonged to Darla. Dianne objects this and everyone starts yelling.

Marilyn questions Eli to see if he has any involvement in Jim Moody's ballot stuffing. Eli told him that they were short votes in the 12th precinct and they needed to get out the vote. Marilyn says there's nothing wrong with that but Eli clarifies and he mentions that he said to do whatever they could. She says it could be a problem if Moody says that Eli ordered him to stuff ballots. Eli doesn't know if their stories will match.

Robyn questions one of the stewardesses, Christina, that was aboard the flight with Darla and Howard. Christina brings up the fact that something happened in the bathroom during the flight, when Kalinda knocks on the door. She's also there to question her.

The next day in court, Christina is questioned about Howard getting in an argument with another passenger about his bag. Alicia argues that their jury shouldn't hear this so Spencer agrees to have them moved out of the courtroom. After the jury leaves, Christina says that Howard stated the bag was his. The prosecution asked if Darla said anything in this encounter and Alicia requests that her jury be brought back into the room.

Eli meets with Moody to discuss their situation. Moody states that he could get three years for election fraud and asks why he would do that. He would get less if he testifies but Eli says he would have no friends. Eli asks if it stops there and Moody leaves.

In court, Cary states that Darla went into the bathroom with another woman and had sex during the flight. He believes that Darla was faking her love for Howard. Darla and Howard stop holding hands at this point but Darla denies the allegations. Dianne tries to convince them that Darla was being helped by another woman because she was having trouble keeping her skirt up. The defense thinks they have a better chance to convict both of them if the jury is brought back into the room. Spencer asks why they want the jury brought back but the defense can't think of a good reason.

Alicia, Cary, Will and Dianne tell Darla and Howard that it looks better if the juries don't believe they are in love. They have a better chance if they fight separately, otherwise they will both go down. Will spots one of his jurors talking to one of Alicia's jurors.

Kalinda approaches Cary at a bar. She offers to buy him a drink and he thinks she's following her. Kalinda says she misses Cary but he isn't happy that she conceived him. She kept Cary's departure a secret for three months and it almost lead to Will firing her. The bartender spills a drink on Cary and he goes to the washroom to clean up. While he's gone, Kalinda notices a text from Robyn on his phone about the Paisley Group. She flips the phone over but she's too tempted and reads the message. It says that LG doesn't know that James Paisley was arrested and it may be the perfect chance to peel a client away from LG.

The next day in court, one of the workers from a resort that Darla and Howard stayed at, is questioned. The two defendants are seen meeting with a man convicted of drug trafficking. The man also runs a scuba diving company so it can't be sure what they are meeting for. Cary argues that Darla had previously met with the drug dealer because she took scuba diving lessons.

Dianne tells Alicia it would be better if they worked together but Alicia suggests she tell that to Will. Dianne tries to talk to Will but he leaves to see the Paisley Group.

Will and Kalinda meet with James Paisley. He's happy with their service but Kalinda brings up the solicitation charge he faces. Will says any firm can get him off but it's still a public matter, LG can get the charge expunged. Paisley gets angry and says that Haley is his granddaughter who is in a wheelchair. Will apologizes for being misinformed. He asks Kalinda what happened and she just says Cary.

In court, Cary receives a call from Paisley and says he would be happy to meet with him. He tells the good news to Alicia, who is on the phone with Marilyn. She has a few questions to ask Alicia as Peter's lawyer. The lawyers get in an argument when Spencer refuses to sequester the jury any further, even though Alicia claims this will ruin her client's chances at a fair trial. She asks to speak to Spencer in private. He agrees to speak to Alicia and Will in his office. Alicia brings up the two jurors she saw talking together. Will denies seeing this though.

Marilyn shows Alicia the video but she doesn't know anything about it. Alicia answers honestly but leaves because she doesn't know anything. Before she leaves she visits Peter in his office. Alicia asks if he was aware of the ballot stuffing but he claims to not be involved. She states that their son Zach will have to testify in court in front of the feds. Alicia tells Peter to fix the situation and he agrees that he will.

Kalinda arrives at Cary's apartment and congratulates him on beating them. He says goodbye to her but she holds the door open. They are even now and she asks him to get a drink together. He doesn't think it's a good idea but he goes with her anyway.

The prosecution questions the head of security at the resort about video of the defendants passing by the drug dealer's room. Robyn notices something in the video and brings it to Alicia's attention. In the video she notices a shoot for a bar that the drug dealer owns. While speaking with Christina, who was packing during their conversation, she noticed that she owned a hat to the same place. Alicia hopes they can argue that Christina and the drug dealer know each other. She isn't sure if she should tell Will or not.

In court, Will questions Christina about attending rehab. He brings up her $45,000 credit card debt before the prosecution objects. Alicia questions her on her ability to pass through airport security easily. She asks Christina if she planted the drugs but Spencer states that the jury should ignore all of the questions Alicia just asked.

The jury for Darla has come to a decision, they find her not guilty. Darla celebrates with her lawyers and Howard. Before the other jury makes their decision they ask for two witnesses testimonies be read back. Howard thinks that's bad news but Alicia says nothing.

Marilyn questions Will as one of Peter's attorneys. She asks if he knew of the video and he agrees that he did. He can't answer any further questions because the knowledge he did or didn't share with Peter is private. Marilyn asks Will to follow her and they go to Peter's office. She asks him to waive attorney client privilege so that Will can answer her questions. Peter asks for a moment alone to speak with Will. Peter asks what Will's testimony would be if he waives privileges. Will admits he would say he brought up the video and that the votes were fraudulent. Peter says that's not how he remembers it and Will asks how he remembers taking back Dianne's judgeship. He's just making a point that politician's have a way of forgetting things they don't want to remember. Peter tells Marilyn that Will is not to waive their attorney client privilege.

Alicia speaks to Howard along with Cary. She says the odds don't look good for them and he should take the plea bargain that is down to four years. Howard asks Alicia what she would do in his position.

Before being taken away, Darla promises Howard that she will wait for him. Alicia and Cary look on as Howard is taken away by police officers.

Eli reads Marilyn's report and she says that she wasn't able to come to a conclusion because Will didn't answer her questions. Marilyn's report is inconclusive until Peter fully cooperates. She warns that Peter is in deep trouble because of one reason, Will Gardner.
